E-shop purchase terms

1. Validity of the General Terms.

1.1 The General Terms and Conditions apply between the customers of Airitc OÜ (hereinafter the Client) and the owner of www.evelily.com:

(hereinafter referred to as www.evelily.com) regarding the legal relationship arising from the purchase of goods.

1.2 The General Terms and Conditions cannot be in conflict with the laws and regulations of the Republic of Estonia and, where necessary (in case of disputes or lack of information), have been supplemented by these Rules.

1.3 www.evelily.com reserves the right to unilaterally change these terms and conditions and product prices for the purpose of improving the efficiency, competitiveness, future development, and upgrading or reorganization of its product range. Changes and supplements to the Terms and Product Prices shall be effective from the date such information is published on www.evelily.com.

1.4 www.evelily.com and the Client wish to trade via the www.evelily.com web site under the conditions set forth in this document. By placing an order and making a payment on the www.evelily.com website, the Customer confirms that he / she has read and agrees to the terms and conditions of sale.

2. www.evelily.com Price list

2.1 The prices of products sold at www.evelily.com are in EUR exclusive of shipping costs (excl. Campaigns)

2.2 All prices on www.evelily.com include VAT.

2.3 www.evelily.com reserves the right to adjust prices. If the Customer has submitted his order before the price change takes effect, the price that was reflected in the order confirmation at the moment of placing the order shall apply to him.

3. Shopping cart and ordering

3.1 The Customer's Shopping Cart is created when he or she has clicked the "Add to Cart" button.

3.2 Adding a Product to the Shopping Cart does not oblige the Customer to make a purchase.

3.3 The Customer may change the quantity of products in the Shopping Cart and, if necessary, remove them from the Shopping Cart.

3.4 Products in the shopping cart are also available to other Customers until the order is confirmed.

3.5 To place an order, the Customer shall press the "Pay" buttons and then "Buy."

3.6 When placing an order, the Customer selects the delivery method and payment method of his choice and verifies that the billing and shipping address details are correct.

3.7 The correctness of the information given in the order depends on the smooth delivery of the products purchased by the Customer and sometimes also the possible additional costs. After clicking "Pay," the order confirmation will be automatically sent to the Client's e-mail address.

4. Payment for ordered goods

4.1 The Customer can choose the appropriate payment method when placing an order (payment methods appear at the bottom of the page when the delivery method is selected).

4.2. Payment can be made by paying the bank link: Swedbank, SEB Bank, Nordea Bank, LHV Bank, Coop Bank Danske Bank.

4.3. International payments can also be made using PayPal 4.4. Payment by credit card is also possible: Visa, Maestro, Mastercard

4.5. All of the above payment methods are mediated by maksekeskus.ee allowing us to receive payments in Finland, Latvia and Lithuania.

5. Cancellation and Refund

5.1 The Customer shall have the right to cancel the order after making a transfer for the ordered products, but prior to the delivery of the products by www.evelily.com. Please inform info@evelily.com in a statement to that effect. Payment for a canceled order will be returned to the Client's bank account as soon as possible, but not later than 14 days after submission of the application.

5.2 If the goods do not conform or do not meet the Customer's expectations, the Customer has the right to return them within 14 days of receipt of the goods. You must notify us of product returns before posting by sending your details and tax invoice number to info@evelily.com

5.3 Returned goods must be unused, labeled and in their original packaging. The goods included in the kit must be returned in the complete set. Footwear with dirty soles is not refundable. The money for the returned goods will be returned to the Client's bank account as soon as possible, but no later than 14 days after receipt of the goods by www.evelily.com. A confirmation of receipt of the parcel will be sent to the Client's e-mail address. When www.evelily.com has made a refund for the returned goods, a refund notification will be sent to the Customer's e-mail address.

5.4 The cost of returning the goods shall be borne by the Client in accordance with § 194 (4) to 10 € of the LOA, unless the delivered item does not correspond to the order.

5.5 If the Customer wishes to exchange the product received for another size or another item, he / she will pay a refund of up to € 10. The cost of posting the Exchange Product will be borne by www.evelily.com the first time, and the Client will bear the cost of any subsequent exchange.

5.6 The right of withdrawal does not apply to products purchased from the www.evelily.com environment where the product's suitability has been ascertained beforehand. If desired, the Customer can exchange the product for another product.

5.7 If the goods are damaged which were not detected by external inspection and which did not occur at the time of opening the package, or if the goods are not what the Customer ordered, the return cost will be borne by www.evelily.com. Upon returning the goods, the customer must attach a receipt for the postage to the parcel.

5.8 In order to exercise the right of withdrawal, the Customer shall carefully open the product packaging without damaging it. If the product being returned is defective and the situation is caused by circumstances caused by the Customer due to improper use of the product, the fault or negligence of the Customer, www.evelily.com reserves the right to offset any decrease in the value of the product to the customer.

6. Right of Complaint and Return of Non-conforming Products

6.1. Pursuant to § 218 (2) of the LOA, the Client has the right to file a claim within two years of receipt of the goods. Any defect that occurs within the first six months is presumed to have existed at the time of purchase and the nature of the defect must be determined by the seller.

6.2. If the defect is of a technological nature, the Customer may require repair of the product and, if repair is impossible or ineffective, replacement or refund.

6.3. In the event of non-compliance of the Product, the Customer shall send an e-mail to info@evelily.com within two months with the following information:   

6.3.1. Customer's name and contact details;

6.3.2. the date on which the complaint was lodged;  

6.3.3. defect in the product, including photographs if available;

6.3.4. Claim against Airitc OÜ;

6.3.5. invoice number, if possible include a copy of the invoice.

6.4. The application must be sent no later than 2 months after the defect has been discovered. Failure to meet this deadline without good reason shall result in the Customer losing the right to request the free replacement of a product or part at www.evelily.com.

6.5. www.evelily.com is not responsible for:

6.5.1. Customer's fault or neglect for product damage;

6.5.2. defects caused by improper use of the product;

6.5.3. normal physical wear and tear of the product under normal use.

7. Liability and Force Majeure

7.1. www.evelily.com shall be liable to the Customer for damages caused by violation of these terms and conditions by www.evelily.com in the cases and to the extent provided by the legislation of the Republic of Estonia.

7.2. The Client shall be liable to www.evelily.com for any damage caused by the Client in violation of these terms and conditions in the cases and to the extent provided by the 9. Gift Card Terms of Use

9.1. Gift Card means a promotional coupon that can be used by a customer (or a third party to whom the Gift Card has been forwarded) within the time specified on the Gift Card to pay for all or part of the products ordered from the Evelily shopping environment at www.evelily.com.

9.2. A gift card can be used only once and only if the total cost of the ordered products is equal to or greater than the value of the gift card.

9.3. The Gift Card is valid for one year from the date of purchase. In case the current law requires the gift card to last for a longer period of time, the duration of the gift card is stipulated by the respective legal regulations. In the event that the gift card is not used before the expiration date of the gift card, the gift card can no longer be used by the person acquiring the gift card or by third parties to whom the gift card may have been forwarded.

9.4. The gift card can be further donated to a third party. This gives the right to the gift card acquirer to resell the gift card.

9.5. You can use the gift card at any time, within the term of the gift card, to purchase products only at www.evelily.com. To use the gift card, you must enter the unique code on the gift card in the appropriate box. The gift card code cannot be filed to purchase a new gift card.

9.6. If the gift card was used for a purchase where the customer has been entitled to a refund, the amount spent by the customer will be refunded by transfer to the customer's account and the value of the spent gift card in the form of a gift card by e-mail. In the event that the Gift Card does not work within the validity period of the Gift Card, the Customer shall be provided with a new Gift Card within a reasonable period of time, which shall be valid for the agreed period or shall be renewed for an agreed period.

9.7. If the customer wishes to cancel the gift card purchase, the customer will be refunded the amount spent on the gift card.

7.3. Neither party shall be liable to the other party and its conduct shall not be deemed to be a breach of these Terms by reason of its delay or failure to perform any of its obligations unless the cause of such delay or omission was beyond its control (force majeure).

8. Other Terms

8.1. www.evelily.com will only use the personal information provided by the Customer to fulfill the Customer's purchase order. www.evelily.com does not disclose information obtained through purchases to third parties except partners for order delivery and as required by law.

8.2. www.evelily.com reserves the right to send Customer information about new products and promotional offers when Customer has subscribed to www.evelily.com newsletter. The Client has the right to request the deletion of his / her data from the www.evelily.com database.

8.3. In matters not regulated by these Terms and Conditions, the Customer and www.evelily.com shall be governed by the laws of the Republic of Estonia and other acts regulating the relations between the parties. Disputes and disputes arising out of or in connection with the fulfillment of these terms and conditions shall, in particular, be settled by negotiation between the Parties. If the disputes arising from the Agreement cannot be resolved by negotiations between the parties, both the Customer and www.evelily.com shall have the right to apply to the Consumer Protection Board or to the court for the protection of their rights.

Disputes and disputes arising out of or in connection with the fulfillment of these terms and conditions shall, in particular, be settled by negotiation between the Parties. If the disputes arising from the Agreement cannot be resolved by negotiations between the parties, both the Customer and www.evelily.com shall have the right to apply to the Consumer Protection Board or to the court for the protection of their rights.

9. Gift Card Terms of Use

9.7. If the customer wishes to cancel the gift card purchase, the customer will be refunded the amount spent on the gift card.

9.8. Gift cards are not exchanged for cash.

9.9. The Customer is solely responsible for the security of the code on the Gift Card and for any unauthorized access. Evelily OÜ is not responsible for the loss or use of the gift card code by unauthorized persons and does not deal with such complaints.

9.10. By purchasing the Gift Card, the Customer agrees to all of the above conditions.

10. Additional Information Any questions and suggestions regarding www.evelily.com products, campaigns or other relevant information are welcome to info@evelily.com. www.evelily.com will try to respond to mail as soon as possible, but no later than 2 business days.
